Yesterday the 7th of September 2021, the NAKSS Court finally strikes out the claim against the Financial Secretary of the Association, Jibril Haruna Abubakar.
The court, sitting at Court 3, Sharia Court of Appeal, G.R.A Ilorin.
In a ruling, delivered by Justice Abdullahi Soliu Dagbo, held that the Claimant has not shown any reasonable cause of action that would entitle her to a right to seek remedy against the defendant.
According to the Court, the claimant is not only required by law to show that the financial secretary has failed to perform his duty, she must also show that such non-performance has directly affected her.
The Court therefore strikes out the case for want of cause of action.
However, the claimant, Ismail Khadijat Moromoke, has instituted a fresh action against the same financial secretary.
The hearing is, according to the notice released by the Judicial Council of the Association, fixed for Monday the 13th of September 2021.
